Terms and Conditions of Sale (T&C)

1. Legal Information

2. Purpose

These Terms and Conditions of Sale (T&C) govern the sale of digital products (code snippets, website templates) on the Site. The products are intended for use with Showit, Canva, and Squarespace, under personal or commercial licenses.

3. Pricing and Payment

Product prices are displayed in dollars ($). As a French small business eligible for VAT exemption (article 293 B of the French General Tax Code), our prices are not subject to French VAT. Consequently, no VAT will be added to your purchase.
Accepted payment methods are Stripe and PayPal.
An invoice is automatically generated after purchase and is available in the customer account as well as sent by email.

4. Delivery

Digital products are available for instant download after payment validation.
The buyer has lifetime access to the purchased products, including future updates.

5. Usage Licenses

Products are sold under two types of licenses: personal and commercial. The rights and limitations of each license are described below.

5.1 Lifetime Commercial License

Duration: The license is valid for the lifetime of the buyer, with no expiration, for the specific product purchased.
Rights Granted:
- Use the design in commercial and personal contexts on an unlimited number of projects.
- Fully customize (100%) the design to meet the buyer’s needs.
- Use the customized design in professional projects, including selling Showit templates or providing services to clients, provided the design has been fully personalized.
Limitations:
- Redistribution or resale of the original or modified design is prohibited without prior permission.
- The buyer may not claim authorship of the original design.

5.2 Lifetime Personal License

Duration: The license is valid for the lifetime of the buyer, with no expiration, for the specific product purchased.
Rights Granted:
- Use the design for personal, non-commercial purposes on an unlimited number of projects.
- Fully customize (100%) the design to meet personal needs.
Limitations:
- Redistribution, resale, or use of the original or modified design in any commercial context is strictly prohibited.
- The buyer may not claim authorship of the design.

5.3 Third-Party Assets (Fonts and Images)

Some templates may include or utilize third-party assets, such as specific fonts or stock photography. These assets remain the intellectual property of their respective creators.

Licensing Responsibility: The license granted by Hestia Studio Shop covers the design and layout of the template only. It does not transfer the license for premium fonts or third-party images.
For Showit/Canva Users: While premium fonts may be technically accessible within the template for convenience upon installation, the Buyer is solely responsible for acquiring the appropriate legal license (e.g., Webfont or Commercial license) from the original font foundry or distributor (such as Creative Fabrica) to use them legally on their public website or commercial projects.
Alternative: If the Buyer chooses not to purchase the specific font license, they must replace the font with a free alternative (e.g., Google Fonts) within the template.

6. Return and Refund Policy

No returns are accepted for digital products.
A full refund is available only if the product is deemed non-functional or incompatible with the buyer’s website, after verification by our team.

7. Liability

The seller is not liable once the product has been modified by the buyer.
The buyer is solely responsible for the use of the products after modification.
Furthermore, Hestia Studio Shop assumes no liability for the Buyer’s failure to obtain proper licenses for third-party assets (fonts, images) used within the final published project.

8. Personal Data

Personal data collected (name, email address, postal address) is used solely for billing purposes and is not used for marketing.
Data is protected in accordance with the General Data Protection Regulation (GDPR).

9. Intellectual Property

The products sold on the Site are protected by intellectual property rights. Alexandra CANTIN is the sole owner of the designs and templates.
Third-party assets included in the products (such as specific fonts or stock photography) remain the intellectual property of their respective creators.
Any unauthorized reproduction, distribution, or use of the products is prohibited and may result in legal action.

10. Dispute Resolution

In case of dispute, both parties agree to seek an amicable solution.
If no agreement is reached, the competent courts are those of Rennes, France.

11. Modification of T&C

These T&C may be modified at any time. The new terms apply to purchases made after their publication.
